"Amnesty schemes are a pragmatic tool for transition but carry the risk of moral hazard." Critically examine with reference to the 2026 Amnesty for PF Trusts.

The Amnesty, 2026, under the EPF Scheme 2026, lets some PF Trusts regularise their exempt status retrospectively [1]. These are trusts recognised under the Income Tax Act, 1961 that have no exemption order under s.17, EPF&MP Act, 1952 or s.143, Code on Social Security (CoSS), 2020 [1]. The scheme is pragmatic, but only if it truly happens once.
Amnesty as a pragmatic transition tool
- Legal certainty: exempt status is validated from the trust's inception [2]. This clears a long-standing grey zone as the Labour Codes replace the 1952 Act.
- Oversight of existing savings: workers' money is already in these trusts. Regularisation brings the trusts "under the statutory umbrella" [1]. The scale is large: 1,002 exempted establishments managed about ₹3.52 lakh crore for over 31 lakh members (2023) [5].
- Flexible exit: a trust may stay exempt or move to EPFO as unexempt [1]. Some are already leaving: 27 establishments gave up exemption in two years, adding about ₹1,689 crore to EPFO [5].
- Tax continuity: trusts keep their income-tax benefits, so employers face no sudden tax hit [1].
Risk of moral hazard
- Rewards non-compliers: trusts that never got the labour-side order get cover for past years. Employers who followed the rules got no such relief.
- Entry checks waived: the minimum headcount, corpus and 3-year compliance rule are all dropped [1]. These are the very filters that keep weak trusts out.
- Proven governance risk: CAG found that employers had not deposited ₹129.20 crore with their Boards of Trustees [3]. It also found that 249 exempted trusts had not invested ₹299.78 crore as required [3]. These were trusts that had passed the full checks.
- Expectation of repeats: any extension tells employers that waiting pays.
- Partial coverage: trusts without tax recognition are left out. So are trusts under the Provident Fund Act, 1925, which the Standing Committee on Labour (2018) found had no clear regulator [4].
Safeguards and way forward
- Cases of fraud or falsified records are excluded [2]. Data sharing between EPFO and the Income Tax Department can flag trusts that do not apply [1].
- EPFO should closely audit new entrants under the simplified exemption SOP approved at the 239th CBT meeting [6]. The 28 December 2026 deadline should be final [1]. A single regulator for all PF trusts is still needed [4].
On balance, the Amnesty, 2026 is a defensible bridge into the CoSS regime. This holds only if strict supervision after entry replaces the waived entry checks, and the window is never reopened. Leniency of this measured kind supports CoSS's aim of secure social security for workers and SDG 8 (decent work).
