  1. Significance of data sovereignty
  2. Necessary safeguards

Data sovereignty means that data created by a state's institutions stays under that state's legal control and is stored and processed within its jurisdiction. The CAG-BHASHINI Anuvaad tool was launched in September 2026 to translate audit documents. It was built with explicit requirements of security, controlled access and data sovereignty [1]. This shows that sovereignty is a precondition for AI in sensitive governance, not an optional extra.

Significance of data sovereignty

  • Confidentiality of state functions: Under Art. 151, CAG reports reach the legislature only through the President or Governor [3]. If drafts were sent through foreign commercial AI tools, this constitutional route could be bypassed.
  • Legal accountability: Data held in India remains subject to Indian law, such as the DPDP Act, 2023 and its Data Protection Board [6]. Foreign servers create conflicting jurisdictions.
  • Strategic autonomy: Indigenous platforms like BHASHINI host 300+ AI language models built with IITs and IIITs [2]. This reduces dependence on foreign vendors who could withdraw service or change their terms.
  • Domain accuracy: Sansad Bhashini fine-tunes in-house AI tools on the parliamentary corpus [5]. Sovereign data therefore also produces better output for the specific context.

Necessary safeguards

  • Technical: Sovereign or on-premise hosting, encryption, role-based controlled access and access logs [1].
  • Human-in-the-loop: Keep human oversight, as the CAG tool does [1]. In an audit, one mistranslated word ("irregular" versus "delayed") can change a finding.
  • Bias and quality checks: Models for low-resource languages may carry cultural or political bias [4]. Government should publish accuracy for each language and label output that no human has checked.
  • Legal clarity: Rules should state which version is authoritative when translations differ. Deployments should follow DPDP obligations, including breach inquiry by the Board [6].
  • Procurement and oversight: Contracts should bar data export. The AI systems themselves should face periodic independent audit.

In sum, data sovereignty protects confidentiality, legal control and strategic autonomy once AI enters the core functions of the state. Sovereign infrastructure should be combined with human oversight, transparent accuracy standards and statutory data protection. That combination lets tools like BHASHINI widen citizens' access to governance without eroding trust. It serves the Digital India vision of inclusive, accountable and self-reliant governance.
