Electoral roll integrity is the foundation of free and fair elections. Critically evaluate the safeguards against wrongful exclusion of first-time voters.

Under the Registration of Electors Rules, 1960, framed under Section 28 of RPA 1950, every new elector must claim inclusion in the roll through Form 6 [1]. When a first-time voter is wrongly left out, usually no one objects on their behalf, so the error goes unnoticed. The safeguards look strong on paper but are weaker in digital practice.

Safeguards in place

  • Statutory form: Form 6 is set out in delegated legislation. Earlier changes to it were made through formal amendment rules, such as the 2016 amendment of Forms 6–8A [5].
  • Youth-friendly eligibility: Since 2022, applicants aged 17+ can apply in advance, and there are four qualifying dates a year instead of one [2].
  • Aadhaar kept voluntary: Under the Election Laws (Amendment) Act, 2021, no application may be rejected for not giving an Aadhaar number [3].
  • Digital access: ERONet processes Form 6 in 14 languages and 11 scripts, and applicants get SMS status updates [4].
  • Judicial oversight: In the Bihar SIR case (2025), the Supreme Court ordered the ECI to publish about 65 lakh omitted names with reasons, searchable by EPIC number [6].

Gaps and weaknesses

  • Safeguards guard deletion more than inclusion: The notice-and-hearing protections apply to names already on the roll [1]. An applicant who never manages to submit Form 6 leaves no record and gets no remedy.
  • Software can override law: An online form can make a voluntary field compulsory in practice. In October 2026, the Opposition alleged an unnotified change to the online Form 6 made through the vendor TCS [7]. This is an allegation only, and no EC response is yet on record.
  • Weak transparency: In Bihar, details of the omitted voters were published only after a court order [6].
  • Burden on the applicant: Youth and migrants have to start the process themselves, so any friction in the form keeps them out.

Way forward

  • Publish a change log for every online form, linking each change to a notification [5].
  • Release Form 6 application and rejection data by age group and state.
  • Show "Aadhaar optional" on screen, and record every instruction to a vendor in writing.

The safeguards have widened the entry point for young voters through advance applications, quarterly qualifying dates and voluntary Aadhaar. However, the digital and administrative processes have not kept pace with the law. Transparent, auditable form changes and published data would make inclusion a protected right, as Article 326's promise of adult suffrage requires.
