Examine how criminal networks with external state backing pose a distinct internal security challenge compared to traditional ideological terror outfits. Discuss with reference to recent UAPA designations.
The Ministry of Home Affairs' declaration of the ISI-backed Shahzad Bhatti Network (SBN) as a terrorist organisation under the Unlawful Activities (Prevention) Act, 1967 [1][2] marks the State's response to a hybrid threat — a smuggling syndicate used as a terror delivery system. Such networks are harder to neutralise than cadre-based ideological outfits, though not beyond the law's reach.
How the challenge differs
- Profit, not ideology, drives recruitment: SBN allegedly drew in "youths and petty criminals" [2], so deterrence through counter-radicalisation is weaker than against indoctrinated cadres.
- Replaceable, deniable manpower: couriers paid per consignment can be replaced within weeks, unlike a hierarchical outfit crippled by removing its leadership.
- Logistics over cadre: the network moves arms, explosives and narcotics [2]; drones have made the channel itself resilient — 53 drone-smuggling recoveries were detected in Punjab up to 30 June 2023, yielding heroin, arms and explosives [3].
- State sponsorship is forensically visible: grenades recovered bore Pakistan Ordnance Factory markings [2], converting a crime file into diplomatic evidence.
- Federal coordination strain: the August operation produced 200+ arrests, 80 FIRs across 14 states [1][2] — one conspiracy fragmented into many state prosecutions.
Where UAPA designation helps, and where it falls short
- Listing makes membership and financing offences in themselves and permits attachment of proceeds of terrorism under the 2019 amendment [4] — decisive against a profit-driven network.
- Yet "membership" fits a cadre body better than a paid supply chain; and PRS notes the Act provides no hearing before listing, with relief only through a post-facto judge-headed Review Committee [5].
The designation is therefore a beginning, not an outcome. Consolidating linked FIRs before NIA Special Courts [5], attaching financiers' assets, and scaling BSF anti-drone coverage certified by the ARDTC [3] would convert a legal notification into durable internal security — with procedural safeguards keeping the instrument constitutionally sound.
