The United Nations Compensation Commission (UNCC), created by the Security Council after Iraq's invasion of Kuwait — condemned by Resolution 660 (2 August 1990) [1] and followed by sanctions under Resolution 661 [2] — is the only large-scale international reparations body to have completed its mandate, making it the natural benchmark for such mechanisms.

Design strengths: an assured funding source

  • Awards were paid from a Compensation Fund financed by a levy on Iraqi oil export proceeds, delinking payment from the defaulting state's willingness to pay [3].
  • Claims were sorted into six categories — four individual, one corporate, one for governments and international organisations — allowing mass, standardised processing rather than case-by-case litigation [4].
  • The final payment was made on 13 January 2022, and the Commission closed after Security Council confirmation that its mandate was fulfilled [3].

Individual claims: wide reach, shallow depth

  • Of roughly 2.7 million claims filed seeking about $352.5 billion, some 1.5 million were approved for $52.4 billion — close to 15% of the amount claimed [5].
  • Individuals were paid through their home governments, which favoured documented workers; migrants in informal or domestic employment, lacking contracts and proof of loss, were structurally disadvantaged.

Corporate and state claims

  • Corporate (Category E) and governmental (Category F) claims required audited evidence — feasible for firms and states, not for wage-earners.
  • Kuwait received nearly $3 billion for environmental remediation, including over $2 billion for oil-lake clean-up, the largest follow-up award [6] — showing the model's capacity to price ecological damage.

Limits as a template

  • It rested on an exceptional condition: a defeated state with sellable oil. Where no such revenue stream or Council unanimity exists, replication is unlikely.

The UNCC proves that mass conflict claims can be adjudicated credibly and settled in full. Its lesson for future mechanisms is to retain the assured-funding design while lowering evidentiary thresholds for low-skilled and informal workers — aligning reparations with the SDG-8 commitment to protect migrant labour rights.
