"The independence of the Election Commission rests as much on its appointment process as on its removal safeguards." Critically examine this in light of the CEC & ECs Act, 2023.

  2. Removal safeguards
  3. Assessment

Article 324 gives the Election Commission of India (ECI) "superintendence, direction and control" of elections. Its independence rests on two pillars: who is appointed and how secure their tenure is. The CEC & ECs Act, 2023 [2] put the first into law but tilted it towards the Executive, and left gaps in the second.

Appointment process under the 2023 Act

Strengths

  • A statutory Selection Committee replaces pure Executive discretion. A Search Committee helps it by shortlisting five names [1]. This honours the framers' intent, stressed in Anoop Baranwal v. Union of India (2023), that appointments be regulated by law [1].
  • The Leader of Opposition (LoP) gets a formal seat [1].

Weaknesses

  • The PM and a Union Cabinet Minister give the Executive a 2:1 majority. The SC's interim panel had the CJI instead [1].
  • Recommendations stay valid even if a seat is vacant. Only the LoP's seat can fall vacant, e.g. when the Lok Sabha is dissolved [1].
  • The committee may choose "any other person" who is not on the shortlist [1].
  • Only Secretary-rank officers are eligible, though the ECI does quasi-judicial work. South Africa's election commission includes a judge [1].

Removal safeguards

Strengths

  • The CEC can be removed only like a Supreme Court judge, through a special majority in both Houses [1].

Weaknesses

  • ECs can be removed on the CEC's recommendation [1]. The Commission decides by majority, yet two of its three members have weaker tenure. The ECI itself sought equal protection by amending Art. 324(5) [3].
  • It has no independent secretariat, which the Goswami Committee (1990) recommended [1].

Assessment

  • The two pillars depend on each other. Strong removal protection cannot fix a partisan appointment, and a neutral appointee is weakened if they can be easily removed.

The 2023 Act made appointments more legal but not more neutral, and it kept the unequal removal rules. Four changes would protect free and fair elections, a basic feature of the Constitution:

  • add a neutral member to the Selection Committee
  • bar it from deciding while the LoP's seat is empty
  • give ECs the same removal protection as the CEC
  • give the ECI its own secretariat

These follow the Law Commission's call to strengthen the ECI [4].
