BIMSTEC was set up in 1997 for sectoral economic and technical cooperation. On 13 October 2026 it held its first Home Ministers' Meeting (HMM) in New Delhi, which adopted the Delhi Declaration. India called this a "milestone" for regional security cooperation [1]. BIMSTEC has clearly moved towards security cooperation, but calling it a "security community" goes too far for now.
Evidence of evolution
- Layered architecture: The HMM adds political direction on top of the NSA-level mechanism that was institutionalised at Goa in 2016 [2]. The ministers who control police, borders and investigators now own the agenda directly [1].
- Legal scaffolding: The Counter-Terrorism, Transnational Crime and Drug Trafficking Convention has been in force since 2021. The Mutual Legal Assistance (MLA) Convention was signed in 2022 [2].
- Institutional maturity: The Charter came into force in May 2024, and Security became a formal pillar led by India [2].
- Shared threat perception: The Declaration calls the Bay of Bengal a "common security space". It condemns cross-border terrorism, backs UNSC 1267 sanctions and flags technology-enabled trafficking into scam centres [1].
Limitations
- Unfinished legal toolkit: The MLA Convention is only signed. The extradition convention is still under discussion, and the trafficking MoU has only reached the "draft agreed" stage [2]. India can use a multilateral convention for extradition when it has no bilateral treaty with a country [3], but BIMSTEC does not yet have one.
- Soft commitments: Cooperation is "complementary to, not a substitute for" bilateral channels, and it must follow domestic laws [1].
- Consensus and non-interference: Any one member can stall a decision [2]. Members cannot press Myanmar to shut scam hubs on its soil [1].
- Implementation lag: The HMM was decided in 2018 but first held only in 2026 [1]. The Secretariat took 17 years to set up [2].
- Not a replacement: In 2025 BIMSTEC adopted the Maritime Transport Agreement and Bangkok Vision 2030 [2]. Security has been added to the economic agenda; it has not replaced it.
Overall, the HMM gives BIMSTEC a working security pillar, but not yet the binding obligations of a security community. BIMSTEC can close that gap by ratifying the MLA Convention, finalising the extradition and trafficking texts, and setting up standing protocols for sharing information. That would turn declarations into real cooperation, advance India's Neighbourhood First, Act East and MAHASAGAR policies [2], and support SDG 16 on strong institutions.
