1. At a Glance

  • What changed: For the first time, the Union government has widened the "any person" category in the Census Rules, 1990. Private school teachers and members of "institutions, societies and trusts" can now be appointed as Census enumerators [6].
  • Who did it: The Registrar General and Census Commissioner of India (RG&CCI) issued the change through a notification in the official gazette [6].
  • Why it was done: About 34 lakh enumerators are needed for the Population Enumeration phase. Officials say government school teachers alone cannot finish the job in time [6].
  • Why it matters for UPSC: It brings together Census administration, Centre–State roles, the rights of private unaided schools, judicial review, and India's first digital and caste-enumerating Census [1][6].

2. Why in the News

  • Gazette notification (Oct 2026): RG&CCI widened the pool of people who can be engaged as enumerators [6].
  • Litigation: During the House Listing Operations (HLO), private teachers in Uttar Pradesh, Maharashtra and Haryana were asked by their State governments to do enumeration duty, and they went to court [6].
  • Court stay: The Punjab & Haryana High Court stayed two Haryana government communications that sought details of teachers for the Census. This gave interim relief to private unaided schools from deploying their staff [6].

3. Background & Evolution

  • Conventional practice: Enumerators have mostly been government school teachers, revenue officials and other State government officials [6]. They are appointed by State governments and do census work alongside their regular duties [1].
  • Legal base: The "any person" category already existed in the Census Rules, 1990. The Oct 2026 notification only widened who falls within it [6].
  • Milestones of Census 2027:
  • 30 Apr 2025: The Cabinet Committee on Political Affairs (CCPA) decided to include caste enumeration in Census 2027 [3].
  • Union Cabinet approval: The scheme for conducting Census 2027 was approved with an outlay of ₹11,718.24 crore [2].
  • Self-enumeration and HLO: HLO began on 1 April 2026 in eight States/UTs, after a 15-day self-enumeration window [4].
  • Phase 1 (HLO/Housing Census): Runs April–September 2026 [1].
  • Phase 2 (Population Enumeration): Scheduled for February 2027 [1]. The reference date is 00:00 hrs, 1 March 2027 [2].

5. Multi-Dimensional Analysis

Administrative

  • The enumerator requirement (~34 lakh) is larger than the government-teacher pool. Widening the pool is meant to keep the Census on schedule [6].
  • State governments appoint enumerators [1], so States carry out the drafting of private staff and also face the litigation that follows [6].
  • The app works offline and uploads data once a connection is available. Enumerators therefore need training in device use [1].

Legal / Constitutional

  • The change rests on a gazette notification widening the "any person" category in the Census Rules, 1990 [6].
  • The P&H High Court stay shows that drafting staff of private unaided institutions can be challenged in court [6].
  • Expected legal issues are compulsion versus consent, the autonomy of private institutions, and whether a duty imposed by notification is proportionate.

Social / Educational

  • Taking teachers off for enumeration can disrupt classes. Private schools now face the same burden that government schools already carry [3][6].
  • Caste enumeration beyond SC/ST makes the data more sensitive. Enumerator neutrality and training become important [6].

Governance / Ethical

  • Data privacy is a concern when non-government personnel handle household and caste data.
  • Accountability for private enumerators (oath, penalties, liability) needs to be clear.

Technological

  • This is the first digital Census: data goes directly from the field to the server, with no paper handling [1].
  • Self-enumeration is optional. Its ID is checked by the enumerator during the house visit [1]. More than 5.72 lakh households had used it early in the exercise [4].

6. Recent Developments (last 12–18 months)

  • 30 Apr 2025: CCPA approved caste enumeration in Census 2027 [3].
  • Cabinet: Approved the Census 2027 scheme with an outlay of ₹11,718.24 crore [2].
  • 1 Apr 2026: HLO began in eight States/UTs after a self-enumeration window [4].
  • Telangana: Phase 1 ran 11 May – 9 June 2026, fully digital. Head-of-household caste was collected in phase 1 [5].
  • Apr 2026: PIB released the backgrounder "Census 2027: India's First Digital Enumeration Exercise" [1].
  • Mid-2026: Pre-test for Population Enumeration and digital self-enumeration [7].
  • Oct 2026: RG&CCI notification widened the enumerator pool. On the same day, the P&H High Court stayed Haryana's communications on teacher details [6].

7. Prelims Hooks

  • The notifying authority for enumerator eligibility is the RG&CCI, not the ECI or the State Election Commission [6].
  • The "any person" enumerator category comes from the Census Rules, 1990 [6].
  • Private school teachers and members of institutions, societies and trusts are now eligible as enumerators [6].
  • Census 2027 is India's first digital Census [1].
  • It is the first Census in independent India to count caste beyond SC/ST [6].
  • The CCPA approved caste enumeration on 30 April 2025 [3].
  • The Census 2027 outlay is ₹11,718.24 crore [2].
  • The reference date is 00:00 hrs, 1 March 2027 [2].
  • Phase 1 is Houselisting & Housing Census (Apr–Sep 2026). Phase 2 is Population Enumeration (Feb 2027) [1].
  • The Population Enumeration questionnaire has 40 questions [6].
  • CMMS is the central portal that monitors Census progress [1].
  • A Self-Enumeration ID is generated after online self-enumeration and checked by the enumerator [1].
  • The Punjab & Haryana HC gave interim relief to private unaided schools against deploying staff for the Census [6].

8. Can a Rule Change Force Private Staff to Do Census Work?

  • The parent law lets the State appoint "persons". It does not name private employees
  • The Census Act, 1948 lets the State government appoint persons as census officers to take, help with or supervise the census in an area [14].
  • Under the Census Rules, an enumerator is an officer appointed under section 4(4) of the Act [14].
  • The private teachers who went to court argued that the Act gave no power to draft them [10].

  • The rules were changed only after the courts stepped in

  • High courts first stayed orders drafting teachers from aided and unaided private schools. Only then were the Census Rules amended [10].
  • So the notification is a repair after a court loss. It is not part of an advance plan.
  • A notification can change the Rules. It cannot widen the Act. If the Act's word "persons" is read narrowly, the new rule can still be challenged.

  • Refusing has a real cost, which is why consent matters

  • Under section 11, a census officer who refuses a duty under the Act can be fined up to ₹1,000. Some offences under the same section can also bring up to three years in prison [14].
  • Once private teachers become enumerators, these penalties can apply to them too. For people outside government, being drafted is not a soft request.

9. Why the RTE Exception Does Not End the Argument

  • Section 27 allows census duty, but only as a narrow exception
  • Section 27 of the RTE Act says no teacher shall be put on non-educational work. The only exceptions are the decennial population census (the census held once every ten years), disaster relief and election duties [11].
  • The Act says "no teacher", not "no government teacher". So the census exception may cover private teachers too [11].
  • The government can therefore say the RTE Act already allows this work. The schools can say the RTE Act only removes a bar. It does not create a power to draft anyone.

  • Courts have looked at when the work is done, not only whether it is allowed

  • In 2016 the Madras High Court said using teachers for NPR (National Population Register) work did not break the RTE Act [12].
  • But it ruled that teachers should not be made to do this work during school hours [12].
  • So the real test for States is scheduling. A blanket order that takes teachers out of class is easier to strike down than one limited to after school.

10. What Government Teachers' Workload Already Warns Us

  • The present pool is already stretched
  • Reports from the field say Census duty has pushed some government teachers' working day to 12–13 hours [13].
  • The official requirement is ~34 lakh enumerators [6]. PIB's figure for enumerators and supervisors mobilised is ~31 lakh [1]. Both come from the note, and they are different measures. Still, the gap explains why the Centre went looking for more staff.

  • Adding private teachers spreads the same loss of classroom time to more schools

  • The burden does not shrink. It is only shared across more schools.
  • The children who lose class time are now in both government and private schools.
  • The Census becomes more workable. The cost to learning is still there.

11. Private Enumerators Are Already Covered by Census Law

  • The note's worry about accountability is partly answered by the Act itself
  • All census officers are deemed public servants under the Indian Penal Code [14]. A private teacher appointed as an enumerator therefore carries the same legal duty as a government clerk.
  • An amendment also made it an offence for a census officer to neglect "reasonable diligence" (the normal care expected in the job) in any census duty [14].

  • The weak point is supervision, not the law on paper

  • Government staff answer to a department that can take action against them. A private teacher's employer is a school management with no role in the Census.
  • Collecting caste data beyond SC/ST [6] raises the stakes if training or supervision is uneven.

12. What Each Actor Should Do Next

  • Parliament could put private staff into the Act itself
  • The challenge rests on the Act not giving this power [10]. Clear words in section 4 of the Census Act would settle the matter in a way a notification cannot.

  • State governments should draft private teachers only outside school hours

  • This follows the Madras High Court's reasoning on NPR duty [12]. It also keeps orders within RTE section 27 [11], so they are less likely to be stayed.

  • The RG&CCI should reach private institutions through their managements first

  • Haryana's orders sought teacher details directly and were stayed [6]. Going through the school management, with notice, lowers the chance of the next order being stayed.

  • District census officers should report on private enumerators separately

  • Errors in caste data are hard to fix after the reference date [2]. Tracking private enumerators separately on the CMMS portal [1] would show early whether the new pool needs more training.

13. Anchors for Answers

  • Data: ~34 lakh enumerators needed for Population Enumeration [6], against ~31 lakh enumerators and supervisors mobilised [1]. Government teachers report 12–13 hour days on Census duty [13]
  • Law/Case: Census Act, 1948: section 4 (State appoints census officers), section 11 (penalty for refusing duty), census officers deemed public servants [14]. RTE Act, 2009, section 27 (census is one of three allowed non-teaching duties) [11]. Madras HC, 2016: NPR work by teachers is allowed, but not during school hours [12]. Article 23(2) of the Constitution allows the State to impose compulsory service for public purposes
  • Comparison: Election duty is the closest Indian parallel. It is the other main exception in RTE section 27 and has also been challenged in court for taking teachers out of class [11]

14. Mains Relevance

15. Related Topics to Study Next

  • Census Act, 1948 and Census Rules, 1990: These are the statutory basis for enumerator duties and penalties.
  • Caste Census / SECC 2011: Compare it with the earlier socio-economic caste data exercise.
  • Delimitation after Census 2027: The Census data is expected to trigger delimitation [3].
  • National Population Register (NPR): Its link to the houselisting phase is a frequent area of confusion.
  • Teachers on non-academic duties (RTE Act, 2009): The RTE limits which non-teaching duties teachers can be given.
  • Digital Personal Data Protection Act, 2023: Relevant to the privacy of digital Census data.
  • Women's reservation (106th Amendment): Its operation depends on the first Census after commencement, followed by delimitation.

16. NCERT Concepts to Revise

  • Enumerator (Economy): The article is about who can be appointed enumerators; revise what enumerators do and why training matters.
  • Census 2027 (Geography): The note is about Census 2027: first digital census, caste count, 1 March 2027 reference date.
  • Caste census (Polity): Counting all castes, not just SC/ST, makes enumeration sensitive and is a likely exam theme.
  • Right of Children to Free and Compulsory Education Act 2009 (Polity): Governs private unaided schools and limits on non-teaching duties for teachers, central to the court dispute.
  • High Court (Polity): The Punjab & Haryana High Court stayed Haryana's orders, giving private schools interim relief.
  • Federalism (Polity): The Centre notifies the rules while State governments appoint enumerators, showing Centre–State roles in the Census.

17. Common Errors / Trap Areas

  • RG&CCI vs ECI: Census enumerators are not election staff, and the RG&CCI is not the ECI.
  • Enumerator numbers: ~34 lakh is the requirement for the PE phase [6]. ~31 lakh is the enumerators-plus-supervisors figure PIB gives as already mobilised [1]. Do not mix them up.
  • Caste "first": It is the first caste count beyond SC/ST in independent India. SC/ST have always been enumerated [6].
  • Phase order: HLO (2026) comes first and Population Enumeration (Feb 2027) second. The reference date is 1 March 2027, not the start of HLO [1][2].
  • Scope of the HC stay: The stay protected private unaided schools on an interim basis. It did not strike down the Census Rules [6].
