15th Constitutional Amendment Act 1963

Polity & Governance glossary

Topic: Amendment of the Constitution and the Basic Structure · NCERT: Class 11, Ch 9 "Constitution as a Living Document"

Meaning

The 15th Constitutional Amendment Act, 1963 raised the retirement age of High Court judges from 60 to 62 years. NCERT calls this a technical amendment. A technical amendment changes the wording of the law but makes little real change to how the Constitution works.

Example

NCERT uses the 15th Amendment to show that many amendments are routine adjustments. They are not big political changes. So the large number of amendments does not by itself mean that the Constitution has been unstable.

Don't confuse with

  • 54th Constitutional Amendment Act, 1986: also a technical amendment about judges, but it dealt with their salaries, not their retirement age.
