Cultural rights
Topic: Political Theory: Freedom and Rights · NCERT: Class 11, Ch 5 "Rights"
Meaning
Cultural rights protect a people's culture, language and identity. NCERT gives two examples: primary education in one's mother tongue, and the right to set up institutions to teach one's language and culture. They matter in a diverse country like India, where minorities need to keep their identity alive.
Example
Art. 350A asks states to provide primary education in the mother tongue for children of linguistic minorities. Arts. 29-30 protect a minority's right to preserve its language, script and culture, and to set up and run its own educational institutions.
Don't confuse with
- Communitarianism: a political theory that says shared community values must shape rights. Cultural rights are specific legal guarantees, not a whole theory.
- Economic rights: these are about material needs like wages and housing, not about identity.
