Enforcement Case Information Report
Also called: ECIR · Topic: Statutory, Regulatory and Quasi-judicial Bodies · NCERT: Beyond NCERT
Meaning
An Enforcement Case Information Report (ECIR) is the Enforcement Directorate's internal record that opens a money-laundering case under PMLA 2002. It is not an FIR (First Information Report, the record police make when a crime is reported). The ED does not have to give a copy of it to the accused. Because of this, courts have added other safeguards so that the accused still knows why they were arrested.
Example
In Pankaj Bansal (2023), the Supreme Court held that the ED must give the accused the grounds of arrest in writing, even though it need not share the ECIR.
Don't confuse with
- FIR: an FIR is a police record under criminal law, and the accused can get a copy. "ECIR is an FIR" is a common Prelims trap. It is FALSE.
