Equal treatment versus identical treatment
Topic: Equality and Social Justice · NCERT: Class 11, Ch 3 "Equality"
Meaning
Treating people as equals is not the same as treating them identically, which means in exactly the same way. Sometimes people need different treatment to have the same chances in life. NCERT's chapter on equality makes this point when it moves from formal equality to real-life equality. Liberals stay careful about it, because caste and apartheid were also systems that treated groups differently. So every departure from identical treatment must be justified, and it must not create a new group that dominates others.
Example
Giving maternity leave to a woman employee, or special equipment to a blind student, treats them as equals but not identically. NCERT calls both justified. A separate basketball court for one gifted player is different: it is not an equality claim at all.
Don't confuse with
- Formal equality: this asks the law to treat everyone the same. Equal treatment can sometimes require the law to treat people differently.
- Discrimination by birth: caste rules or apartheid also treated people differently, but they did it to keep one group on top, not to make people equal.
