GNCTD (Amendment) Act 2021
Also called: Government of National Capital Territory of Delhi (Amendment) Act 2021 · Topic: State Government: Governor, Chief Minister, State Legislature and Union Territories · NCERT: Beyond NCERT
Meaning
This law changed the GNCTD Act 1991, the Act that runs Delhi's elected government. It says that "government" in laws made by the Delhi Assembly means the Lieutenant Governor (LG). It requires the LG's opinion before the elected government takes action on certain matters. It also stops Assembly committees from examining the day-to-day running of the government. The Act moved real power back towards the LG.
Example
After GNCTD v. Union of India (2018), the elected Delhi government could act on most matters without first asking the LG. The 2021 Act made the LG's opinion necessary on the matters it specifies.
Don't confuse with
- GNCTD (Amendment) Act 2023: That later Act dealt with control of services, meaning officers and staff. It reversed the Supreme Court's ruling of 11 May 2023. It set up the National Capital Civil Service Authority, with the LG having the final say.
