Localised emergency

Meaning

A localised emergency is a proposal of the Punchhi Commission (2010). It suggests that emergency-type powers under Articles 355 and 356 be applied to only a district or part of a state, for up to three months. The aim is to deal with local trouble without the Union taking over the whole state. It is only a proposal and is not in the Constitution.

Example

If violence broke out in two districts of a state, a localised emergency would let the Union act in those districts alone for up to three months. Today the main options are action under Article 355 or President's rule over the whole state.

Don't confuse with

  • National emergency in a part of India: since the 42nd Amendment (1976), Article 352 lets a national emergency cover only part of India. This is already in the Constitution. A localised emergency is a proposal under Articles 355-356.
