Paragraph 16A of the Symbols Order
Also called: Suspension of recognition · Topic: Political Parties, Party Systems and Anti-defection · NCERT: Beyond NCERT
Meaning
Paragraph 16A of the Election Symbols (Reservation and Allotment) Order 1968 lets the Election Commission suspend or withdraw a party's recognition. It can do this if the party breaks the Model Code of Conduct, the ECI's rules on how parties and candidates must behave during elections. It can also do this if the party refuses to follow the Commission's lawful directions. The Symbols Order comes from Article 324, so this power is not given by an Act of Parliament. It gives the ECI a way to make parties obey its rules.
Example
Suppose a recognised party keeps breaking the Model Code during a campaign and ignores the ECI's orders to stop. Under paragraph 16A, the ECI can suspend the party's recognition. Without recognition, the party loses benefits such as its reserved symbol.
Don't confuse with
- Paragraph 15 of the Symbols Order: it deals with symbol disputes, where the ECI decides which rival group is the real party.
