President's Act

Polity & Governance glossary

Also called: Article 357 · Topic: Emergency Provisions and President's Rule · NCERT: Beyond NCERT

Meaning

A President's Act is a law made by the President for a state that is under President's rule. Under Article 357, Parliament can hand the state legislature's law-making power to the President. The President then makes laws for that state. Such a law continues even after President's rule ends, until the state legislature changes or repeals it (Article 357(2)).

Example

While a state is under President's rule, its assembly is suspended or dissolved. A law the state needs, for example on a local tax, can then be made as a President's Act. It stays in force after the elected government returns unless the new assembly changes it.

Don't confuse with

  • Ordinance: a temporary law the President or a Governor makes when the legislature is not sitting. It lapses unless the legislature approves it. A President's Act does not lapse on its own.
