Qualified veto
Topic: Union Executive: President, Vice-President, Prime Minister and Council of Ministers · NCERT: Beyond NCERT
Meaning
A qualified veto is a veto (the power to reject a bill) that the legislature can override by passing the bill again with a higher majority, not just a simple majority. So the head of state's "no" is strong but not final. The Indian President does not have this kind of veto.
Example
In the USA, if the President vetoes a bill, Congress can still make it law by passing it again with two-thirds of each House. India has no such provision. Under Art. 111, when a returned bill is passed again by Parliament, a simple majority is enough and the President must sign.
Don't confuse with
- Suspensive veto: India's President can return a bill once. Parliament can override this by passing the bill again with an ordinary majority, not a higher one.
- Absolute veto: withholding assent so that the bill dies. Nobody can override it.
