Satender Kumar Antil case
Also called: Satender Kumar Antil v. CBI (2022) · Topic: Justice Delivery: Subordinate Courts, Tribunals, Legal Aid and Judicial Reforms · NCERT: Beyond NCERT
Meaning
Satender Kumar Antil v. CBI is a 2022 Supreme Court judgment on bail. The Court sorted offences into categories and gave bail guidelines for each one. It repeated the old principle that bail should be the rule and jail the exception. It also asked Parliament to pass a separate Bail Act, because bail law was scattered and applied unevenly. The case matters because many prisoners in India are undertrials, meaning people held while their trial is still going on.
Example
After 2022, trial courts dealing with bail pleas in less serious offences were expected to follow the Antil categories, so people were not jailed without need. Reformers still cite its call for a Bail Act, since the new criminal laws of 2023 brought no bail reform.
Don't confuse with
- Arnesh Kumar guidelines (2014): these deal with arrest. For offences punishable with up to 7 years, police should not arrest automatically. Antil deals with bail after a person is taken into custody.
