Also called: Sunil Batra v. Delhi Administration · Topic: Judiciary: Independence, Structure, Judicial Review and Activism · NCERT: Class 11, Ch 6 "Judiciary"

Meaning

Sunil Batra v. Delhi Administration (1980) was an early public interest litigation (PIL) case on prisoners' rights. A prisoner in Tihar jail wrote a note to Justice V.R. Krishna Iyer about torture of a fellow prisoner. The Supreme Court treated this note as a writ petition. The case advanced prisoners' rights and became a leading example of epistolary jurisdiction, where letters are treated as petitions.

Example

A simple note from inside a jail, with no lawyer and no court fee, led the Supreme Court to look into how prisoners were being treated in Tihar. This made the court reachable even for prisoners.

Don't confuse with

  • Hussainara Khatoon case (1979): that PIL was filed by an advocate about Bihar undertrials and speedy trial. Sunil Batra began with a prisoner's own letter about torture.
