Illegal immigration sits on a federal seam. "Citizenship, naturalisation and aliens" and "admission into, and expulsion from, India" are Union subjects (List I, Entries 17, 19). But police and public order, the tools of detection, belong to the States (List II) [1]. Managing it is therefore a test of cooperative federalism.

Constitutional division of roles

  • Union: makes the law, guards borders, issues visas and runs the Bureau of Immigration [2].
  • States: police detect and verify; district offices issue the documents through which irregular migrants become embedded.
  • Art. 355: Sarbananda Sonowal (2005) treated large-scale influx into Assam as "external aggression", making protection of States a Union duty [6].

Federal friction points

  • Uneven burden: border States carry most of the load but often differ politically with the Centre.
  • Weak machinery: the Section 6A judgment (2024) found Assam's detection system and Foreigners Tribunals inadequate [5]; other States fear an NRC-style replay.
  • Blame-shifting: the MHA panel lists "administrative laxity" as a cause [4], implicitly faulting State enforcement.
  • Internal migrants: the panel's focus on urban centres and industrial corridors [4] risks profiling inter-State workers protected by Art. 19(1)(d)/(e) [1].

Recent Union initiatives and their federal impact

  • Immigration and Foreigners Act, 2025: replaces four older laws; lets police of Head Constable rank and above arrest without warrant; hospitals and educational institutions must report foreigners [2]. It is a Union law that runs on State machinery.
  • High-Powered Demography Mission: announced on Independence Day 2025 as a national-security priority [3].
  • Demography panel portal (2026): seeks post-2011 inputs to design a permanent system for identification, detention and deportation [4]. It consults the public through a portal, not the States through a formal forum.

Way forward

  • Use the Inter-State Council (Art. 263) [1] to agree joint procedures.
  • Define "irregular mobility" in writing; provide time-bound tribunals with legal aid, as Art. 21 requires [1].
  • Rely on Census data, not self-selected submissions.

Effective control needs the Union's sovereign powers and the States' administrative reach working together. A consultative, data-led framework that respects due process would secure borders without eroding federal trust, giving real shape to cooperative federalism.
