Curfews in hostels, "drop-home-by-dark" advisories and family vetoes on night travel are framed as protection, yet they shift the burden of safety from the offender to the victim. Where mobility is rationed by gender, Article 21's personal liberty becomes conditional — and inequality is reproduced in the name of preventing it.
How "protection" becomes restriction
- Displaces accountability: the norm regulates women's conduct rather than male behaviour or policing quality, normalising dominance as common sense.
- Shrinks economic agency: restricted night mobility closes off shift work, hospitality, IT and health-sector jobs, feeding low female labour force participation.
- Naturalises exclusion: public space at night is coded male; "culture" is invoked as fixed, though culture is dynamic and continuously renegotiated.
- Chills reporting: a woman "out late" risks being blamed, reinforcing the roughly two-thirds of incidents that go unreported.
Restriction has not delivered safety
- NCRB Crime in India 2022 recorded 4,45,256 crimes against women, a 4% rise over 2021 — about 51 complaints an hour [1].
- Most offences occur in familiar settings — cruelty by husband or relatives alone is 31.4% [1] — so night curfews target the least likely site of harm.
The State's own model is enabling, not restrictive
- The Nirbhaya Fund (2013), a non-lapsable corpus administered by the Department of Economic Affairs, funds projects that expand women's presence in public space [2].
- Safe City Projects in eight cities — Ahmedabad, Bengaluru, Chennai, Delhi, Hyderabad, Kolkata, Lucknow, Mumbai — use CCTV and smart lighting that eliminates dark alleys, plus ERSS-112 and 827 Anti-Human Trafficking Units [3].
- Yet of ₹7,712.85 crore allocated to FY 2024-25, only ~76% (₹5,846.08 crore) was utilised [3] — an implementation gap that lets restriction fill the vacuum.
Safety and freedom are not competing goods: the State's design philosophy already treats lighting, transport and rapid response as the answer, while society still reaches for the curfew. Full fund utilisation, gender-audited urban design and women-friendly night transport would align practice with SDG-5 and with Article 15(3)'s promise of empowerment rather than confinement.
