The MWPSC Act, 2007 makes the maintenance of a citizen aged 60 or above a legal duty of children and relatives, enforced through Tribunals [3]. AVYAY (2021) is the Ministry of Social Justice and Empowerment's umbrella scheme. It provides shelter, care and assistive devices under the idea of "Ageing with Dignity" [1]. Both give effect to Article 41. They fit together well on paper, but the fit is uneven in practice.

How they complement each other

  • Duty plus safety net: the Act enforces family responsibility. IPSrC homes catch indigent seniors who have no relative to claim against, and 764 senior citizen homes are now supported [2].
  • The law's promise, the scheme's delivery: Section 19 envisages a 150-bed old-age home in every district [4]. IPSrC Grant-in-Aid to NGOs funds such homes [1].
  • Access to the remedy: Elderline 14567 offers guidance and field help in abuse cases [7]. This helps victims reach the Act's protections.
  • Family-first logic: "Ageing in Place" and the Rashtriya Vayoshri Yojana (RVY) devices keep elders living with their families [1]. This supports the Act's intent.
  • District-level oversight: District Committees under the District Magistrate select beneficiaries and monitor homes [1].

Where the complementarity breaks down

  • Coverage gap: only 482 of 700+ districts had care homes [5]. IPSrC funds only NGOs that apply, so districts without a capable NGO stay uncovered.
  • Slow enforcement: the 2019 Amendment Bill had to propose a 60-day deadline for applicants aged 80+ [5]. This shows that Tribunal cases were taking longer.
  • Uneven legal reach: the Act takes effect in a State only once that State notifies it [4].
  • No regulator: care homes have no registration standards, so District Committee monitoring has no benchmark to check against [5].
  • Care without income: neither the Act nor AVYAY gives cash to a widow with no relative to sue. Pensions sit separately under IGNOAPS.
  • Thin health support: there are only 17 Mobile Medicare Units nationally [2], even though LASI shows widespread functional limitations among the elderly [1].

Way forward

  • One care home and one multi-service day care centre per district. At least two days a week set aside for maintenance cases. A common online portal to file and track applications [5].
  • A comprehensive social security law for senior citizens [6] that brings together the Act, AVYAY and pensions.

The Act and AVYAY work as layers: family duty first, then community care, then institutional care, each catching those the previous layer missed. Closing the gaps in coverage, enforcement and income support would make them truly complementary. That would fulfil Article 41 and the spirit of SDG 1.3 on social protection for all.
