Sunset review

Meaning
A sunset review is a check made when an anti-dumping duty or countervailing duty (CVD) nears its end. These duties lapse after 5 years unless the review shows that removing them would bring the injury back. The review stops trade remedy duties from becoming permanent protection by default. In India, DGTR (Directorate General of Trade Remedies) runs the review and recommends, and the Finance Ministry decides.
Example
India imposes an anti-dumping duty on a chemical from China. Near the end of 5 years, DGTR holds a sunset review. If it finds that dumping and injury are likely to return, the duty is extended. If not, the duty ends.
Don't confuse with
- Provisional safeguard duty: this is a short, temporary duty against an import surge that can last up to 200 days. It is a separate time limit from the 5-year sunset on anti-dumping and countervailing duties.
