Fundamental Rights Sub-committee
Topic: Making of the Constitution: Constituent Assembly, Sources and Salient Features · NCERT: Beyond NCERT
Meaning
This was a sub-committee of the Constituent Assembly, chaired by J.B. Kripalani. It drafted the list of fundamental rights. It worked under the Advisory Committee on Fundamental Rights, Minorities and Tribal and Excluded Areas, which Sardar Patel chaired. Its list passed through the Advisory Committee to the Assembly and became the base of Part III.
Example
The rights the sub-committee listed, such as equality before the law and personal liberty, grew into Part III (Arts. 12–35). Today a person can go directly to the Supreme Court under Art. 32 to enforce these rights.
Don't confuse with
- Advisory Committee (Patel): the parent body. The sub-committee drafted the rights, and the Advisory Committee reported to the Assembly.
- Minorities Sub-committee: a separate sub-committee under H.C. Mookerjee that dealt with protecting minorities, not the general list of rights.
