Integrated judiciary

Polity & Governance glossary

Also called: Single integrated judicial system · Topic: Judiciary: Independence, Structure, Judicial Review and Activism · NCERT: Class 11, Ch 6 "Judiciary"

Meaning

An integrated judiciary means India has one single pyramid of courts. The Supreme Court is at the top, High Courts are below it and district and subordinate courts are at the base. The same courts enforce both Union laws and state laws. Class 11 links this to India having a single Constitution for both the Union and the states. Because of this system, Supreme Court rulings guide every court in the country.

Example

A case under a state law can start in a district court, go on appeal to the High Court and finally reach the Supreme Court. In the USA, federal and state courts are separate systems that deal with different laws.

Don't confuse with

  • Dual court system (USA): in the USA, federal courts and state courts form two separate systems. India has one chain of courts for all laws.
