Also called: Article 224A · Topic: Judiciary: Independence, Structure, Judicial Review and Activism · NCERT: Beyond NCERT
Meaning
Under Art. 224A, the Chief Justice of a High Court can ask a retired judge to sit and work as a judge of that High Court again. The President's consent is needed. The provision helps courts deal with arrears, meaning the large backlog of pending cases.
Example
In Lok Prahari (2021), the Supreme Court encouraged High Courts to use Art. 224A to clear their pending cases.
Don't confuse with
- Additional and acting judges (Art. 224): these are new temporary appointments made by the President. Art. 224A brings back judges who have already retired.
- Ad hoc judge (Art. 127): an ad hoc judge is a serving High Court judge who sits in the Supreme Court for a short time.
