Right to work, education and public assistance
Also called: Article 41, Right to work · Topic: Directive Principles and Fundamental Duties · NCERT: Class 7, Ch 10 "The Constitution of India: An Introduction"; Class 11, Ch 2 "Rights in the Indian Constitution"
Meaning
Article 41 is a Directive Principle. It asks the State to secure:
- the right to work;
- the right to education;
- public assistance (help from the government) in unemployment, old age, sickness and disability.
The State is to do this "within the limits of its economic capacity", so it depends on how much the State can afford. Class 7 labels Art. 41 "Welfare Government". It is a socialistic directive.
Example
MGNREGA (2005) gave 100 days of paid unskilled work a year to every rural household that asked for it. This put into practice a "partial right to work" under Art. 41. The VB–G RAM G Act 2025 replaced it from 1 July 2026 with a 125-day guarantee.
Don't confuse with
- Adequate means of livelihood (Art. 39(a)): this is the broad goal of enough means to live. Art. 41 asks for specific support, such as work and public assistance.
