RTI appeals
Also called: First appeal, Second appeal · Topic: Transparency, Accountability and e-Governance · NCERT: Beyond NCERT
Meaning
RTI appeals are the two steps an applicant can take if they are refused information, get no reply, or are unhappy with the reply. A first appeal goes to a senior officer in the same public authority within 30 days (s.19(1)). A second appeal goes to the Central or State Information Commission within 90 days (s.19(3)). The Commission can fine a PIO who is at fault ₹250 a day, up to ₹25,000 (s.20). This two-step system is what makes the right to information enforceable.
Example
A PIO does not reply to an RTI application within 30 days, which counts as a refusal. The applicant files a first appeal with the senior officer. If that also fails, the applicant takes a second appeal to the CIC.
Don't confuse with
- Going to court: an RTI appeal goes to officers and Information Commissions under the Act, not to the courts.
