Special provisions for Andhra Pradesh and Telangana
Also called: Article 371D · Topic: Special Provisions, Scheduled and Tribal Areas · NCERT: Class 11, Ch 7 "Federalism"
Meaning
Articles 371D and 371E were added by the 32nd Amendment in 1973. They came after the agitations over the Mulki rules, which were local-residence rules for jobs, and after the Six-Point Formula of 1973. Article 371D lets the President make sure people from different parts of the state get fair chances in public jobs and education. It does this through local cadres, which group state jobs by region, and through local reservation, which saves seats for local people. It also provides for an Administrative Tribunal to settle disputes about service matters. Article 371E provides for a central university. Both articles now cover Telangana as well as Andhra Pradesh.
Example
In P. Sambamurthy (1987), the Supreme Court struck down the proviso that let the state government override the tribunal's orders. The Court held that it hurt judicial review, the power of courts to check government action. The University of Hyderabad was set up under Article 371E.
Don't confuse with
- Article 371J (Karnataka): both give local reservation. Article 371J also sets up a regional development board for Kalyana-Karnataka. Article 371D does not create a development board.
