Special provisions for Arunachal Pradesh
Also called: Article 371H · Topic: Special Provisions, Scheduled and Tribal Areas · NCERT: Class 11, Ch 7 "Federalism"
Meaning
Article 371H was added by the 55th Amendment in 1986. It gives the Governor of Arunachal Pradesh a special responsibility for law and order. The Governor must consult the council of ministers but then decides using their own individual judgement. The Governor's decision is final. This is an exception to the normal rule that a Governor acts on ministers' advice. The article also says that the state assembly must have at least 30 members. It reflects the state's sensitive border location.
Example
On a law-and-order matter in Arunachal Pradesh, the Governor can act differently from what the state ministers advise, after hearing them.
Don't confuse with
- Article 371A (Nagaland): it also gives the Governor a special responsibility for law and order. It also protects Naga customary law and "land and its resources", which Article 371H does not.
