Polity & Governance glossary

Also called: Article 371G · Topic: Special Provisions, Scheduled and Tribal Areas · NCERT: Class 11, Ch 7 "Federalism"

Meaning

Article 371G was added by the 53rd Amendment in 1986, after the Mizo Accord. It says that no Act of Parliament on certain subjects applies to Mizoram unless the state assembly decides by a resolution that it should. These subjects are:

  • Mizo religious and social practices;
  • Mizo customary law, meaning traditional community law, and its procedure;
  • civil and criminal justice under customary law;
  • ownership and transfer of land.

The article also says the assembly must have at least 40 members.

Example

If Parliament passed a law on land ownership, it would not apply in Mizoram until the Mizoram assembly agreed to it.

Don't confuse with

  • Article 371A (Nagaland): it protects "land and its resources". Article 371G protects only "land".
