Bar on courts in panchayat electoral matters
Also called: Article 243O · Topic: Panchayati Raj: Rural Local Government · NCERT: Beyond NCERT
Meaning
Article 243O bars courts from two kinds of panchayat election disputes. First, laws on delimitation (drawing the boundaries of wards) and on allotting seats to wards cannot be challenged in any court. Second, a panchayat election can be challenged only through an election petition, a formal complaint filed before an authority named in state law. This keeps courts from stopping an election halfway through, and still leaves one proper way to dispute a result.
Example
Suppose a losing candidate says votes in a gram panchayat election were counted wrongly. They cannot file an ordinary writ petition to cancel the result. They must file an election petition before the authority set up under the state's panchayat law.
Don't confuse with
- Article 329: this is the matching bar for elections to Parliament and state legislatures. Article 243O covers only panchayats.
