Educational qualification for panchayat candidates

Polity & Governance glossary

Topic: Panchayati Raj: Rural Local Government · NCERT: Beyond NCERT

Meaning

Article 243F sets 21 as the minimum age to contest panchayat elections. It also lets state law add other conditions. Using this power, some states added extra conditions for candidates, such as minimum schooling. In Rajbala v. State of Haryana (2015), the Supreme Court upheld Haryana's law. That law required a minimum level of schooling, a toilet at home and no unpaid dues.

Example

Under Haryana's law, a woman in a village who never finished school cannot contest for sarpanch, even if her neighbours want to elect her. Critics say rules like this keep many poor women and Dalits out of local elections.

Don't confuse with

  • Two-child norm for panchayat candidates: it bars candidates because of how many children they have, not their schooling. It was upheld in a different case, Javed (2003).
